Our offer
The content of your web site will include:

a. e-commerce for CD sales online. Sell your CDs online through Paypal.com or any other Credit Card processing company of your choice. Note: Paypal is free but other credit card processing companies may charge a fee, whereby you will be financially responsible. Payment will be made directly to your account and you will be financially responsible for its management.
b. In both options sales will be made directly to you.
c. We would help you Sign up a free credit card processing account with Paypal.com, if you do not own one already.
d. We offer series of moderate-price web hosting/publishing companies to choose from. Since the web site will be yours, you are responsible for its maintenance and any other fees charged to keep it on the Internet.
e. We pay for the first month of web hosting during which period you would be given a 30 day grace to identify omissions or present additions.
f. You could update your web contents whenever you want. All you need do is e-mail or mail us the updates and your site will be updated within 10 working days (excluding Saturdays, American public holidays, and Sundays). (See price plan below).
HOW TO PROCEED
1. After selecting a plan below and paying for it, we would send you a contract.
2. You will be requested to send us the information you want on your web page(s).
To have T&T Music (tomtmusic.com) design you a professional artist web site, you must send the following materials, agree to the terms below, and we would take care of the rest.

AUDIO FOR YOUR PAGE
You will be requested to send some or the entire songs on your CD. We may put the entire CD content on your web site if you instruct us do so, especially if you want to sell the CD from your web site.
Note: T&T Music will not be liable for any material you ask us to include on your web site. We would send you a project contract as soon as we receive your payment and web content.
PAGE INFORMATION
You will be requested to provide information to be added to your web pages. In case you do not have professionally written information and need help, you may notify us. We will provide a content expert at $100 a page.
Note: We do not accept materials infringing government or state laws, unauthorized copyright, racially inclined contents, infringement to other people's religion, political, and social beliefs, or pornographic materials).

For money orders and checks, please make sure they are accepted by USA Banks and credited to T&T Music Records. Note: T&T Music Records is not liable for rejected checks. It is not possible to process your check or money order at this web site, but you can process your credit card below by clicking on the "PayPal" secure server button and in a minute you are done. It's best to print out the requirements before proceeding to payment.

GENERAL TERMS
a. Assigning us to design you a web site implies you agree that the only recourse for mistakes or omissions on our part to your web site and not limited to incorrect information, improper content, and infringement to your privacy or that of your associates shall be addressed by notifying us via Sign up mail or e-mail and NOT through a legal channel. We would fix the problem at our convenient time.
b. T&T Music is solely responsible for all upgrading services on your web site. Whenever, you plan to upgrade your web site, all you need do is send us the upgrades (photos, music, information, links, etc.) with the appropriate fee. Note: It takes 10 working days to upgrade the web site (excluding Saturdays, American public holidays, and Sundays).
c. T&T Music reserve the rights to withdraw your web site if:
1. Payment deadlines are not met.
2. The terms of the web designing contract are not upheld.
3. When the customer fails to meet payment deadlines for web hosting and other web related services.
Representations and Warranties. The term "Material" means all material that you submit to us, including Standard Program Material, Sample Songs, DAM Songs and Collateral Material, as applicable. You represent and warrant that (a) the Material is your or your band's own original work, and contains no sampled material, (b) you have full right and power to enter into and perform this agreement, and have secured all third party consents necessary to enter into this agreement, (c) the Material does not and will not infringe on any third party's copyright, patent, trademark, trade secret or other proprietary rights, rights of publicity or privacy, or moral rights (d) the Material does not and will not violate any law, statute, ordinance or regulation; (e) the Material is not and will not be defamatory, trade libelous, pornographic or obscene, (f) the Material does not and will not contain any viruses or other programming routines that detrimentally interfere with computer systems or data, (g) all factual assertions that you have made and will make to us are true and complete. You agree to indemnify and hold us and our customers harmless from any and all damages and costs, including reasonable attorney's fees, arising out of or related to your breach of the representations and warranties described in this section. You agree to execute and deliver documents to us, upon our reasonable request, that evidence or effectuate our rights under this agreement.
